USER AGREEMENT
The website masterairfare.com is designed to assist customers worldwide in booking the most affordable flights to destinations across India. By accessing or using this website, you agree to comply with the terms and conditions outlined in this User Agreement (“Agreement”).
This Agreement is a binding contract between you and Master Airfare, operated by Avocation Travels Private Limited (“Company”).
This Agreement applies to anyone (“User”) who purchases, intends to purchase, or inquiries about services or products offered by Master Airfare through its online channels, including the website (masterairfare.com), mobile app, mobile site, or offline channels such as call centers and offices (collectively referred to as “Sales Channels”).
Each of the User and the Company is individually referred to as a “Party,” and collectively as “Parties.”
ELIGIBILITY TO USE
- Users must be at least 18 years old, as per the Indian Majority Act, 1875, and possess the legal authority to enter into this Agreement.
- If you are below 18 years of age, you are prohibited from registering as a User or transacting on the website.
- The Company reserves the right to terminate your membership or block access to the website if it discovers you are a minor or incompetent to enter this Agreement or have provided false age information.
Before using any of the Company’s services, the User must read and agree to all terms and conditions in this Agreement. Users who do not agree should refrain from using the Company’s services.
INTELLECTUAL PROPERTY RIGHTS
- All content on the website, including but not limited to logos, images, audio, software, text, and icons (“Content”), is owned by the Company, its licensors, or other material providers and is protected under applicable intellectual property laws.
- The Company does not grant Users the right to use proprietary logos, service marks, or trademarks in any manner. Unauthorized use of Content violates applicable laws.
- This Agreement permits Users to access the website solely for personal, non-commercial use.
If you identify any intellectual property infringement on the website, you may report it by emailing info@masterairfare.com with:
- Identification of the copyrighted work.
- Location of the infringing material on the website.
- Proof of ownership of the copyrighted work.
- Your contact details.
USAGE OF WEBSITE
- The website and mobile app must be used for lawful purposes only.
- Users must not download, share, or transfer data from the platforms for commercial or unauthorized purposes.
- Certain features are restricted to registered Users. Registration requires providing accurate personal information, which will be handled per the Company’s Privacy Policy.
The Company reserves the right to revoke access to the platforms without prior notice if necessary.
The Company strives to maintain a virus-free platform but does not guarantee immunity from malware. Users accessing or downloading content do so at their own risk and are responsible for any resulting damage to devices or data loss.
Feedback or complaints regarding the website or app can be directed to info@masterairfare.com, and the Company will investigate as it deems appropriate.
BOOKING BY TRAVEL AGENTS
- Travel agents, tour operators, and aggregators must register as B2B agents or partners with explicit Company permission to use the website for commercial purposes.
- Violation of this clause may result in termination of this Agreement, blocking access, or withholding payments without notice.
Discounts and offers are valid only for legitimate bookings made by Users.
LIMITATION OF LIABILITY
- The Company acts solely as an intermediary, connecting Users with service providers (e.g., airlines, hotels, bus operators).
- The Company is not liable for issues arising from the services provided by these service providers.
The Company is not responsible for inaccuracies in service provider information published on the website or app.
USER’S RESPONSIBILITY
- Users must read and understand all terms of this Agreement and related policies before using the services.
- If making bookings on behalf of others, the User is responsible for ensuring the third party understands the applicable terms and policies.
By accessing the platforms, Users consent to receive communication via calls, texts, or emails from the Company, regardless of preferences set under the National Consumer Preference Registry (NCPR).
SECURITY AND ACCOUNT INFORMATION
- Users must safeguard account-related information, such as usernames and passwords. Any breach must be reported immediately to info@masterairfare.com.
- While the Company employs industry standards to secure data, it cannot guarantee absolute protection against security breaches.
The Company may disclose personal information to third parties in anonymized form for lawful purposes. Personal information may also be shared with law enforcement or courts as required by law, without prior notice to the User.
FEES AND PAYMENT
- The Company may charge additional convenience or service fees, which will be disclosed before booking. Any undercharged amount due to technical errors must be paid by the User.
- Users are responsible for paying applicable taxes and levies, including changes in tax rates.
- Refunds, if applicable, will be processed as per the Company’s and service provider’s policies.
Users should only transfer payments to the official Company accounts. The Company is not liable for losses arising from payments made to unauthorized individuals.
For refunds, amounts will be returned only to the original payment source.
SPECIAL FARE RESTRICTIONS
Special fares offered by the Company are strictly non-refundable and non-changeable under any circumstances. Users are advised to carefully review and confirm their bookings before proceeding with payment.
INSURANCE
The responsibility of obtaining adequate travel insurance lies solely with the User unless explicitly stated otherwise and provided by the Company for a specific service or product. Any claims arising from insufficient insurance coverage will not be entertained by the Company.
In cases where the Company facilitates insurance as part of its service or product, such insurance will be governed entirely by the terms and conditions of the third-party insurance provider. The Company functions only as an intermediary between the User and the insurance provider. Consequently, all claims, queries, or disputes regarding insurance coverage must be directed to the insurance provider. The Company assumes no liability for claims that are denied or partially approved by the insurance provider.
COMPLIANCE WITH THE LIBERALIZED REMITTANCE SCHEME (LRS)
Under the Reserve Bank of India’s (RBI) guidelines, all transactions conducted under the Liberalized Remittance Scheme (LRS), including international bookings on the Company’s platforms, require the submission of PAN details. The User agrees to provide accurate PAN information either at the time of booking or immediately thereafter.
If the booking is made for a minor traveler, the Company reserves the right to request the PAN details of the minor’s parent or legal guardian. Non-compliance with this requirement may result in booking cancellations.
The User also certifies that their total foreign exchange expenditure, including the current transaction, falls within the permissible limits set by the RBI for the fiscal year. If the cumulative limit is exceeded before the transaction is processed, the Company will be obligated to cancel the booking in accordance with applicable laws and issue refunds as per the cancellation policy.
The User authorizes the Company to access PAN details from their profile, prior transactions, or share these details with third parties solely for compliance and verification purposes. The Company does not collect PAN information without explicit consent from the User. Users who wish to opt out or update their PAN information may do so via their profile settings.
VISA REQUIREMENTS
All international bookings made through the Company are subject to the visa requirements of the destination country, as well as any transit visa obligations for intermediate stops. It is the User’s sole responsibility to secure the necessary visas based on their travel itinerary.
The Company shall not be held responsible for any disruptions to travel resulting from visa denials, delays, or lack of required documentation, even if the User avails of the Company’s visa services. Refunds, if applicable, will be processed in accordance with the booking’s terms and conditions.
COMPLIANCE WITH TAX COLLECTED AT SOURCE (TCS)
The User agrees to comply with the Tax Collected at Source (TCS) regulations under the Income Tax Act of 1961 for bookings made through the Company’s platform.
For international travel packages, Users are required to provide accurate PAN details. If incorrect PAN details are provided or the details do not match the User’s information, the Company reserves the right to cancel the booking and issue a refund in accordance with the applicable refund policy.
FORCE MAJEURE
The User acknowledges and agrees that the Company shall not be held responsible for delays, interruptions, or cancellations of services due to unforeseen events beyond its control. Such events include but are not limited to natural disasters, pandemics, government actions, terrorism, or technical disruptions.
In such cases, the Company will make reasonable efforts to provide an alternative service or refund the booking amount, deducting applicable service charges, if recoverable from the Service Provider. However, the User understands that the Company, as an intermediary, cannot be held liable for losses caused by such events.
THIRD-PARTY ADVERTISEMENTS
The Company’s platforms may include advertisements or links to third-party websites. The Company does not control or endorse the content of these third-party websites and cannot be held responsible for any inaccuracies, errors, or omissions in their content. The User accesses such websites at their own risk.
RIGHT TO CANCEL
The Company reserves the right to cancel a booking at its discretion if the User provides false, incomplete, or misleading information. The Company may also cancel bookings upon the request of law enforcement or regulatory authorities without requiring the User’s prior consent.
In cases of cancellation, the Company will not be held liable for any financial losses or damages incurred by the User.
SPAMMING AND PHISHING
The Company’s representatives will never request sensitive financial details such as credit card numbers, CVV codes, or banking information via unauthorized channels. Nor will they ask Users to install any third-party applications.
If the User encounters such requests, they are advised to contact the Company immediately at info@masterairfare.com. The Company disclaims all liability for financial losses arising from phishing or fraudulent activities.
RIGHT TO REFUSE
The Company retains the right to accept or decline a booking without providing a reason. Bookings will not be confirmed until full payment, including applicable taxes and fees, has been received.
If the User violates the terms of the Agreement, provides inaccurate information, or engages in behavior that may breach these terms, the Company reserves the right to suspend or terminate the User’s account. Users whose accounts are revoked may not re-register using different credentials.
INDEMNIFICATION
The User agrees to indemnify and hold harmless the Company, its affiliates, and their officers from any claims, liabilities, or expenses arising from breaches of the Agreement or violations of applicable laws.
CONDITIONS RELATED TO FLIGHT TICKETS
The Company acts solely as an intermediary between the User and the Airline. All bookings are subject to the terms and policies of the respective airline.
- Airlines reserve the right to modify flight schedules, cancel flights, or change itineraries without prior notice. The Company shall not be held liable for such changes.
- Baggage allowances are determined by the airline, and certain fares may exclude check-in luggage. Users are advised to verify baggage policies with the airline.
- Refunds and cancellations are processed per the airline’s policies, with convenience fees paid to the Company remaining non-refundable.
Infant fares are applicable only for children under 24 months throughout the journey. Infants must be accompanied by an adult, and all required documentation must be provided. The User assumes full responsibility for ensuring compliance with airline policies and documentation requirements.
Conditions Related to Charter
- Definition and Booking Process:
Charter refers to the booking or hiring of an entire jet, aircraft, or helicopter offered by the charter company. Charter facilities booked through the Website or Mobile Application are governed by the terms and conditions of the respective Charter Company, including cancellation and refund policies. These terms will be communicated to the User during booking and outlined in the booking confirmation voucher. - Role of the Company:
The Company acts solely as an intermediary, providing the platform for Users to book Charters. The contractual agreement is between the User and the Charter Company. - Charter Company Authority:
The Charter Company reserves the right to cancel or reschedule charters due to various factors such as weather, operational needs, lockdowns, or technical/mechanical issues. Alternate arrangements are subject to availability and the Charter Company’s discretion. Any fare differences resulting from rescheduling will be invoiced based on the prevailing rates. - Baggage and Passenger Allowance:
Policies regarding baggage allowance, the number of passengers, meals, and other services are determined solely by the Charter Company. While the Company may facilitate communication between the User and the Charter Company regarding specific requests, fulfillment of these demands rests entirely at the Charter Company’s discretion. - Modifications and Charges:
Any changes to an existing charter booking will incur additional charges as per the Charter Company’s policy. The User is responsible for paying these charges. - Travel Documentation:
The User acknowledges the responsibility to provide passenger information such as names, nationality, passport details, and medical reports well in advance for security clearance. Failure to furnish proper travel documents or being denied boarding is entirely the User’s responsibility. - Refunds and Cancellation:
Refunds will follow the Charter Company’s cancellation and fare policies and are contingent on the Company receiving the amount from the Charter Company. The convenience fee charged by the Company during booking is non-refundable. Refunds will be processed to the original payment account.
Conditions Related to Hotels
- Role of the Company:
The Company acts as an intermediary, providing a platform for Users to browse and book accommodations, including hotels, homestays, and other types of lodging. The Company relies on information provided by the hotel, including images, amenities, and room details, which are for reference only. - Hotel Service Quality:
The Company holds no liability for service quality, differences between hotel descriptions and actual settings, or service-related issues at the hotel. - Booking and Check-In Policies:
Hotel bookings are subject to the information provided at the time of reservation. If a hotel denies check-in for reasons such as overbooking or policy constraints (e.g., refusing local residents or unmarried couples), the Company is not responsible. The Company may offer alternative accommodations or a refund, but no compensation will be provided beyond this scope. - User Responsibilities:
The User is liable for any damages caused to hotel property, and the hotel will determine the extent and cost of these damages. Guests must present valid identification at check-in. Failure to provide appropriate ID or false information may result in denied check-in without refund. - Payment Terms:
- Prepaid Model: Users pay the entire booking amount during reservation, which includes hotel tariffs and any applicable fees.
- Pay-at-Hotel Model: Payment is made directly to the hotel during check-in. For international bookings, payment will be in local currency or as determined by the hotel.
- Inaccurate payment details may result in booking cancellation and legal action by the Company.
Conditions Related to Bus
- Company’s Role:
The Company provides a platform connecting passengers with bus operators but does not operate buses or offer transportation services. - Service Delivery:
Bus details, such as schedules, fares, routes, and seat availability, are controlled by the bus operator. The Company is not liable for discrepancies in these details or for operational issues, such as delays, cancellations, or lost luggage. - User Responsibilities:
Users must be present at the boarding point at least 30 minutes before departure with valid identification and the booking voucher. Tickets are non-transferable. - Cancellations and Refunds:
Tickets may be canceled via the Company’s platform, subject to the cancellation terms specified on the ticket.
Conditions Related to Train
- Booking via IRCTC:
Train ticket bookings are facilitated through IRCTC and subject to Indian Railways policies. The Company does not influence seat allocation, scheduling, cancellations, or other railway operations. - User Responsibilities:
Users must log in with valid IRCTC credentials during the booking process and carry proper identification during travel. - Cancellations and Refunds:
Cancellations can only be processed online, in accordance with Indian Railways policies. Refunds for waitlisted tickets are processed automatically after chart preparation, minus applicable Company charges. - Concessions and Discounts:
Concessions for senior citizens, women, and children are determined by Indian Railways. Users should refer to the official railway website for detailed information.
For further inquiries or updates, Users are encouraged to refer to the respective Charter, Hotel, Bus, or Train operators’ policies.
CONDITIONS RELATING TO CABS
- Definition of Terms
- Cab: Refers to any vehicle used to transport passengers to their desired destinations.
- Cab Operator: Denotes any individual or organization providing vehicles along with drivers for passenger transport.
- Services Provided by the Company
- Outstation Cabs: Facilitates bookings for vehicles operated by Cab Operators holding All-India Tourist Permits (AITP) for intercity travel. The Company acts solely as a facilitator, connecting Users with Cab Operators based on the User’s request.
- Rental Cabs: Enables Users to exclusively hire vehicles maintained by AITP-licensed operators for intracity or interstate travel by reserving the entire vehicle.
- Airport Transfers: Specifically caters to Users traveling to and from airports within the same city. This service does not include interstate airport transfers.
- Company’s Role and Limitations
- The Company does not operate its own fleet of taxis but partners with Cab Operators to offer various cab services, types, and pricing options.
- The Company serves solely as an intermediary between Users and Cab Operators, with all transactions occurring directly between these two parties.
- Cab Operator Responsibilities
- Cab Operators must ensure they hold all necessary licenses, permits, insurance, and approvals required for the booked journey.
- The Company makes no guarantees about the Cab Operators’ compliance with regulatory requirements.
- Liability Disclaimer
- The Company shall not be held responsible for any claims relating to trip timeliness, safety, uninterrupted travel, vehicle condition, driver behavior, cancellations, or baggage loss/damage.
- The Company is not liable for inaccuracies in information provided by Cab Operators on its platform.
- Breakdowns or Accidents
- If a cab breaks down or is involved in an accident and the Cab Operator fails to arrange alternatives, the Company will reimburse the User for the distance not covered. All other liabilities rest solely with the Cab Operator.
- Payment Models
- Prepaid: Users pay the full booking amount upfront, covering the base fare, applicable taxes, and additional service or convenience fees charged by the Company.
- Part Payment: Users pay a portion of the booking amount upfront and settle the remainder directly with the driver at the time of boarding.
- Additional Charges
- Booking amounts for rental and outstation cabs exclude tolls, state taxes, traveler taxes, parking fees, and other levies, which must be borne by the User.
- The total trip cost is based on actual usage (kilometers and hours) calculated garage-to-garage unless specified otherwise.
- User Responsibilities
- Users must present valid photo ID proof to the driver or Cab Operator at the time of boarding.
- Changes to the departure time, boarding point, or drop-off location are not allowed after booking.
- Users are responsible for the safety of their personal belongings and compliance with traffic laws.
CONDITIONS RELATING TO ACTIVITIES AND SERVICES
- Definition of Activities
- Includes day tours, spa services, adventure sports, cruises, dining experiences, and other services booked through the platform.
- Company’s Role
- The Company acts as a facilitator, connecting Users with Activity Providers. The transaction or service fulfillment is exclusively between the User and the Activity Provider.
- Liability Disclaimer
- The Company is not liable for issues related to delays, cancellations, safety, service inadequacy, or incidents during the Activity.
- The Company’s maximum liability is limited to refunding the booking fee received.
- User Responsibilities
- Users must adhere to Activity Provider terms and provide required credentials like ID proof or booking vouchers.
- Users must meet eligibility criteria (e.g., age, medical fitness) and comply with cancellation/refund policies set by the Activity Provider.
- Special Offers and Coupons
- Coupons must be redeemed before their expiration date and cannot be returned or canceled once purchased.
Visa Services
The Company operates strictly as an intermediary for visa processing and assumes no responsibility for the approval or denial of any visa. The issuance of a visa is solely at the discretion of the respective Embassy or High Commission.
Nature of Services
- Non-Advisory Role: The Company does not provide visa consultancy or advisory services. Its role is limited to processing the application based on the User’s instructions. The User is solely responsible for understanding the visa requirements of their destination(s) and providing accurate instructions to the Company to initiate the application process.
- Scope of Assistance: The Company’s assistance includes:
- Informing the User of the required documentation for visa applications.
- Collecting the User’s submitted documents.
- Submitting these documents to the appropriate Embassy or High Commission.
The Company relies on information provided by the relevant Embassy or High Commission but does not guarantee the completeness, accuracy, or likelihood of a visa application’s success.
Visa Processing and Timelines
- Processing Information: The Company may provide details on average processing times for visa applications. However, Users are responsible for initiating the application well in advance to meet their travel timelines.
- Variability in Requirements: Each country has unique passport and visa requirements, such as passport validity or blank page stipulations. These requirements are subject to change, and while the Company endeavors to provide updated information, it cannot guarantee completeness or accuracy.
Decision Authority
- Discretion of Embassies: The decision to approve or deny a visa is entirely at the discretion of the concerned Embassy or High Commission. Various factors such as User-provided information, nationality, residency, age, gender, occupation, recent travel, and other personal details may influence this decision. The Company does not participate in the evaluation or approval process.
- Face-to-Face Interviews: The Embassy may require Users to attend an interview, for which the Company will notify the User of the date, time, and other specifications. The Company does not participate in the interview process.
Third-Party Contractors
The Company may employ third-party vendors for visa applications in certain countries. These contractors handle the procurement of visas, and the Company is not responsible for their independent decisions, including the rejection of applications due to perceived risks of denial.
Documentation and User Responsibilities
- User Obligations:
- The User must provide all necessary and authentic documentation for the visa application process. The Company is not responsible for verifying the authenticity of the documents or the accuracy of the information provided.
- It is the User’s responsibility to verify that all visas issued are accurate, valid, and meet their travel requirements. This includes ensuring that personal information on the visa matches their passport and travel plans.
- Reapplication and Refusal: If a visa application is refused, the User may choose to reapply or appeal, which will be treated as a new application. Additional service fees and visa fees will apply. The Company will only proceed with reapplications based on explicit User instructions.
Fees and Refunds
- Service Fees: The Company charges a service fee for its role in submitting the application to the respective Embassy. This fee is separate from visa fees, embassy charges, and other costs. Service fees are non-refundable, even if the User decides to withdraw the application or if the visa is denied.
- Additional Costs: Any additional costs such as courier services, passport collection, or other logistical expenses must be borne by the User. Embassy fees and taxes are subject to change without prior notice, and such changes are outside the Company’s control. Once a visa application has been submitted, these fees are non-refundable.
Risk and Limitations
- Passport Handling: The Company will make every effort to securely handle and deliver the User’s passport. However, it is not liable for loss or misplacement of passports by third-party logistic service providers.
- Entry Denial: Even if a visa is granted, local immigration authorities may deny entry at their discretion. The Company is not responsible for such decisions.
- OK to Board: For certain destinations (e.g., Dubai), additional requirements like “OK to Board” clearance may apply. The Company acts solely as a facilitator in these cases, with no control over the airline or department’s decision to grant or deny clearance.
General Disclaimer
The list of countries for which visa services are available is provided on the Company’s website and mobile application and is subject to change at the Company’s discretion. The Company assumes no responsibility for delays, denials, or errors caused by Embassies, High Commissions, or other authorities. Furthermore, the Company is not liable for incidental or additional costs incurred by the User due to delays or refusals.
By using the Company’s services, the User agrees to these terms and acknowledges that the Company’s role is limited to facilitating the visa application process as per the User’s instructions.
Definitions of Terms: Outbound and Domestic Tours
Independent Contractors
For the purposes of this clause, the term “Independent Contractors” refers to any entity or individual engaged to provide services for the User, including but not limited to hoteliers, hotel operators, airline companies, shipping firms, railway operators, ferryboat operators, coach owners, or other service providers selected by the Company.
Outbound Tour
An “Outbound Tour” is defined as any tour organized by the Company outside the territorial boundaries of India. This includes, but is not limited to, pre-packaged brochure tours, special tours, custom packages, cruises, sightseeing trips, carnivals, Cosmos tours, Star Cruise, and similar activities.
Tour Cost
The term “Tour Cost” refers to the cumulative total cost of all services booked by the User for their outbound travel experience.
Booking Fees
“Booking Fees” refers to the non-refundable amount, often treated as a deposit or token money, paid by the User at the time of securing the booking.
Brochure
A “Brochure” encompasses any catalog, pamphlet, email, or other material containing details of an outbound tour’s schedule, activities, and itinerary.
Infant and Child
An “Infant” is defined as a person below the age of two years, whereas a “Child” refers to an individual aged two years or older but below the age of twelve.
Liability of the Company
The Company does not own or operate any airlines, shipping companies, coaches, hotels, transportation vehicles, restaurants, or other facilities mentioned in its brochure. Consequently, the Company is not liable for any delay, substandard service, or deficiencies in services provided by these third-party service providers. Additionally, the Company will not be held responsible for any injuries, death, loss, or damage caused by the actions, negligence, or defaults of its Independent Contractors.
Specific exclusions from the Company’s liability include, but are not limited to:
- Injury or Loss: Personal injuries, illness, accidents, death, theft, or damage to personal belongings, regardless of the cause.
- Service Deficiencies: Delays, disruptions, or poor service resulting from third-party providers.
- Airline or Hotel Issues: Situations like overbooking, route changes, or denial of boarding/check-in, even with confirmed reservations.
- Co-traveller Behavior: The actions of co-passengers or co-travelers causing discomfort, harm, or interference with the User’s enjoyment of services.
- Unforeseen Events: Delays, disruptions, or losses arising from events outside the Company’s control, such as civil unrest, weather conditions, or technical failures.
The Company’s maximum liability under any circumstances will not exceed the total booking cost paid by the User.
Modifications, Disruptions, and Refunds
Service providers, including airlines, hotels, and transportation operators, may fail to honor confirmed bookings due to circumstances like weather, administrative decisions, or operational issues. In such cases:
- The Company will make reasonable efforts to provide alternate arrangements or process refunds, subject to recovery from the respective service providers.
- Users are required to approach the service provider directly for further resolution or reimbursement.
- The Company’s liability in these instances is limited to the refund of the booking amount, after deducting applicable charges.
Brochure Terms
- Content and Updates:
The information in the brochure is accurate at the time of publication but is subject to change due to circumstances beyond the Company’s control. Users will be informed of such changes, if possible, before their tour’s departure. - Pricing Adjustments:
Prices in the brochure are based on prevailing rates at the time of publication. The Company reserves the right to revise prices in response to changes in exchange rates, fuel costs, peak season surcharges, or transportation fares. - Special Terms:
Additional terms specific to each tour may be provided on the website, emails, or ticket vouchers. These should be read alongside the general terms and conditions.
Meal and Special Requests
- Meal Plans:
- Meals provided during the tour are predetermined and specified in the brochure. Requests for specific meals or dietary preferences are subject to availability but cannot be guaranteed.
- Unused meals cannot be claimed for reimbursement.
- Special Requests:
- The Company will attempt to accommodate special requests for customized meals or room preferences but cannot guarantee fulfillment.
- Any additional costs associated with such requests will be borne by the User.
Hotel Accommodation
- Hotel Selection:
Hotels are chosen based on internal evaluations and availability. The Company reserves the right to change hotels if necessary. - Liability:
- The Company is not responsible for inadequate services provided by hotels.
- Users are liable for damages caused to hotel property during their stay.
- Baggage Responsibility:
Users are responsible for their luggage and personal belongings.
Itinerary Terms
- Changes Before Departure:

If Users skip activities due to delays or other personal reasons, no reimbursement will be provided. - Disruption Costs:
The Company reserves the right to recover additional costs incurred due to itinerary disruptions.
“Coach and Seating”
- Coach Utilization:
Coaches are arranged to provide transportation and facilitate local touring as part of the Outbound Tours. Seat assignments are not predetermined, and passengers are required to adhere to seating instructions provided by the tour manager. - Handling of Valuables:
Users are advised not to leave valuable personal belongings unattended while disembarking from the coach. The Company disclaims any liability or accountability for the loss of such items from the coach. It is the User’s sole responsibility to safeguard their luggage and possessions at all times during the trip. - Damage to the Coach:
Any damage caused to the coach by a User due to their behavior or actions will be the User’s responsibility. The Company holds no liability for such occurrences. - Driver Regulations:
Coach drivers operate under strict legal requirements, including limits on maximum driving hours per day and week, and mandatory rest intervals. Users must comply with the daily schedule to ensure the trip proceeds without delays. If sightseeing or other activities are missed due to User-related delays, no refunds will be provided under any circumstances. - Coach Breakdown:
In the event of a coach breakdown, the Company will arrange for a replacement vehicle within a reasonable timeframe. However, the Company will not be liable for any delays caused by the breakdown, traffic congestion, or other factors affecting replacement transportation. - Tipping:
Tipping for services (e.g., porters, coach drivers, guides) is a customary practice worldwide unless otherwise stated in the tour brochure. While tipping remains at the User’s discretion, a nominal mandatory tip is required for coach drivers:- Europe and the UK: €2 per person, per day.
- United States: $2 per person, per day.
- Currency and Traveler’s Checks:
Users are encouraged to carry both local currency (of the destination country) and traveler’s checks or a travel currency card. Traveler’s checks are a secure way to carry money, as they can be easily cashed for a nominal service fee and replaced in case of loss, provided the serial numbers and counterfoils are retained. Alternatively, travel currency cards are the safest option for accessing funds, as they provide 24/7 ATM access. - Accommodations for Minors:
For bookings made for children under the age of 12 without requesting a separate bed, hotels are not obligated to provide additional bedding facilities.
Terms and Conditions Regarding “Bookings Through Third-Party/Travel Agents”
- Authorization:
If a travel agent books a tour on behalf of the User and signs the booking form, it is presumed that the User has authorized the agent to act on their behalf. The agent’s signature is binding on the User. - Relationship with the Travel Agent:
When Users book through a travel agent, the contractual relationship exists between the User and the agent. The Company functions as a service provider to the travel agent. - Contact Information:
Accurate contact information must be provided during the booking process. The Company is not liable for any disputes arising from communication issues caused by incorrect or inaccessible contact details. - Commitments by Travel Agents:
The Company is not responsible for any commitments made to the User by travel agents. Services and amenities provided will align with the Company’s brochures or other official communication at the time of booking. - Reimbursement:
Any refunds for bookings made via travel agents will be processed through the authorized travel agent.
Terms and Conditions for “Deposit Forfeiture”
- Non-Refundable Deposit:
At the time of booking, the Company may require a non-refundable, interest-free deposit. - Cancellation by User:
If the User cancels the booking, fails to adhere to the payment plan, or cannot travel due to personal reasons (e.g., visa denial, health issues), cancellation charges as communicated to the User will apply. - Visa Denial:
If a visa application is denied, the Company will deduct applicable cancellation charges and refund any remaining amount. Any reapplication or appeal will require additional charges.

If a cheque payment is dishonored, the booking will be canceled, and legal proceedings may be initiated. - Tax Requirements:
Cash payments exceeding ₹25,000 require submission of a valid PAN card copy. - Exchange Rate:
The foreign currency component of the trip cost is subject to exchange rate fluctuations, which may alter the trip cost or reimbursement amounts. - Delayed Payments:
Delayed payments may incur interest as determined by the Company.
Terms and Conditions for “Tour Arrangements and Activities”
- User Responsibility:
Users must arrive at the designated meeting point on time. Failure to participate in the tour as scheduled will be treated as a “no-show,” and no refunds will be provided. - Activities at User’s Risk:
Participation in adventurous or other activities carries inherent risks. The Company is not responsible for any health, safety, or well-being issues resulting from such activities. - Tour Membership Revocation:
The Company reserves the right to revoke tour membership if a User’s behavior disrupts the tour or endangers others. - Mandatory Holiday Insurance:
Users must obtain holiday insurance as a condition of booking. - Tour Changes:
Changes to a scheduled tour will be treated as a cancellation, with applicable charges applied.
Related to Self-Driven Cars
- Definition of Cab
The term “cab” refers to all types of transportation vehicles, including sedans, hatchbacks, SUVs, MUVs, and any other vehicle designed for passenger transportation. - Definition of Operator
The word “Operator” refers to any corporation engaged in the rental of motor vehicles. - Company’s Role and Acknowledgment by User
The Company does not provide self-drive taxi services directly and solely acts as a facilitator, allowing Users to schedule a self-drive cab with service providers.- The service contract for self-drive cabs is exclusively between the User and the Operator.
- The Company’s platform displays cab options provided by various Operators.
- The Company cannot be considered an “Operator” under the Motor Vehicles Act, 1988, and the Rent a Cab Scheme, 1989.
- Booking Process and Conditions
- Users must agree to the Operator’s rental conditions, including presenting original identity documents and holding a valid driver’s license.
- If the User fails to present the required documents or valid license, the Operator can refuse to hand over the car.
- The Company issues a confirmation voucher based on the Operator’s approval, with payment amounts determined by the Operator.
- Responsibilities of the Operator
- Operators are solely responsible for delivering the vehicle, collecting it at the end of the booking, and addressing any issues during the pickup process.
- Any disputes over vehicle damages must be resolved directly between the User and the Operator.
- Operators must ensure they have the necessary licenses, permissions, and insurance required to rent vehicles.
- Company’s Disclaimer of Liability
- The Company assumes no responsibility for issues related to punctuality, cleanliness, safety, or condition of the cabs.
- It is not liable for accidents, damages, or injuries resulting from vehicle usage.
- In case of breakdowns or accidents, the Company’s responsibility is limited to facilitating proportional reimbursements, contingent on refunds received from the Operator.
- Additional Charges and Security Deposits
- Users may be required to pay a security deposit, which is governed by the Operator’s policies.
- Additional costs such as tolls, parking fees, permits, or penalties for traffic violations are the User’s responsibility.
- Pricing and Refunds
- The estimated cost at booking may not reflect the final amount, as additional charges may apply after vehicle verification upon return.
- Refunds, if applicable, will be processed based on the Operator’s policies.
- Cancellations and Modifications
- Cancellation policies are determined by the Operator and communicated at the time of booking.
- Convenience or support fees charged by the Company are non-refundable.
- Adherence to Operator Terms
- In addition to these terms, the User must comply with the Operator’s terms and conditions.
Conditions Related to COVID-19
- Cancellations Due to COVID-19
The User acknowledges that the Service Provider may cancel reservations in specific scenarios related to COVID-19, such as:- Displaying symptoms of COVID-19.
- Refusal to adhere to safety protocols, such as wearing face masks or maintaining social distancing.
- Endangering the health or safety of others.
In such cases, the Company holds no liability, and any applicable refunds will be processed subject to the Service Provider’s policies.
- Compliance with COVID-19 Guidelines
Users must follow guidelines issued by the Central and State Governments to prevent the spread of COVID-19. - Government Requirements
Users may be required to download the Aarogya Setu app or complete self-declaration forms for transit points or hotel check-ins.
Severability Clause
If any provision of this Agreement is deemed invalid or unenforceable, it shall not affect the validity or enforceability of the remaining provisions.
Jurisdiction
The courts of New Delhi, India, will have exclusive jurisdiction over any disputes or claims arising out of or related to this Agreement.
Confidentiality
Any information designated as “confidential” by the Company must be kept confidential by the User, except where disclosure is required by law.
Amendments and Modifications
The Company reserves the right to amend or modify this Agreement or any related policies at its discretion.
